This page describes the opt-out rights available to California residents under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). Brivonexi maintains the procedures below to honor requests submitted under these rights.

CCPA Rights Available to California Residents

California residents hold the following rights regarding personal information.

Right to know. Request disclosure of:

  • Categories of personal information collected
  • Specific pieces of personal information held
  • Sources from which the information was obtained
  • Purposes for which the information is used
  • Third parties with whom the information has been shared

Right to delete. Request removal of personal information from Brivonexi records, subject to statutory exceptions for:

  • Pending transaction completion
  • Fraud prevention
  • Legal compliance
  • Similar legitimate operational necessities

Right to correct. Request that inaccurate personal information be updated.

Right to opt out of sale or sharing. Exercised through the procedure described below.

Right to limit use of sensitive personal information. Applies to specific categories such as financial account credentials and precise geolocation.

Right to non-discrimination. No adverse treatment in pricing, service quality, or product availability as a consequence of exercising any CCPA right.

Definition of Selling and Sharing Under California Law

California privacy law defines "selling" and "sharing" with broader meanings than common usage.

Selling personal information means:

  • Disclosing consumer data to an external business or third party
  • In exchange for monetary consideration or other valuable consideration
  • Including arrangements where Brivonexi receives analytics, services, or other value in return for data disclosure

Sharing personal information means:

  • Disclosing consumer data to third parties
  • Specifically for cross-context behavioral advertising
  • Advertising delivered based on consumer activity across multiple websites, apps, or online services
  • Covered even when no monetary exchange takes place

Brivonexi does not engage in the sale of personal information under traditional practices. Use of advertising or analytics tools that facilitate cross-context behavioral advertising may qualify as sharing under the CPRA, in which case California residents retain the right to opt out.

How to Submit an Opt-Out Request

Opt-out requests are accepted exclusively through email at this time.

Subject line: CCPA Opt-Out Request

Required body content:

  • Full legal name of the requester
  • Email address associated with any Brivonexi account or prior purchase
  • Mailing address
  • Confirmation of California residency

A reason for the opt-out is not required under California law and does not need to be included.

Response sequence:

  • Receipt confirmation within 2 business days
  • Verification process initiated upon receipt
  • Opt-out execution within 15 business days of verified identity

Postal mail submissions to the business address are also acceptable but produce slower response times compared to email.

Identity Verification and Processing Time

Identity verification is required by California regulations before any opt-out request can be executed.

Standard verification approach:

  • Match name and email address provided in the request against existing records
  • Records may come from past account activity or order history

Additional verification (when basic matching is insufficient):

  • Approximate date of a prior order
  • Last four digits of a previous transaction confirmation

Processing timelines:

  • Opt-out requests: within 15 business days of verified identity
  • Right-to-know, right-to-delete, right-to-correct requests: within 45 calendar days
  • Extension available: additional 45 days for particularly complex requests

The applicable timeline is communicated to the requester once verification is completed and the scope of the request is assessed.

If identity verification cannot be completed even with supplementary information, the requester receives notification with an explanation. New requests with additional verification data may be submitted at any time.

Right to Non-Discrimination

California law expressly prohibits retaliation against consumers who exercise their CCPA rights. Brivonexi maintains strict adherence to this principle.

Submitting an opt-out request or any other CCPA request produces no adverse effect on:

  • Pricing
  • Service availability
  • Quality of customer experience

Customers who exercise privacy rights continue to receive:

  • Identical product catalog
  • Identical pricing structure
  • Identical support services

No differentiation is applied in any aspect of the commercial relationship on the basis of privacy rights exercise.

Important Notes

Several operational clarifications assist customers in understanding the scope of opt-out requests.

California-only coverage. CCPA rights apply only to California residents. Residents of other jurisdictions may hold rights under their respective state privacy frameworks, evaluated against the applicable governing law.

Essential operations continue. Opting out does not restrict Brivonexi's ability to use customer information for operational necessities, including:

  • Order processing
  • Payment settlement
  • Shipping coordination
  • Customer service delivery
  • Fraud investigation
  • Legal compliance
  • Transactional communications related to purchased items

New orders may require new opt-out. A customer who previously opted out and subsequently places a new order or creates a new account may need to submit a renewed opt-out request, because fresh data collection activities may require a renewed preference. Notice is provided when this applies.

Forward-looking effect. Opt-out applies prospectively from the date of processing. Data transfers that occurred prior to opt-out completion cannot be reversed.

Account deletion is separate. Opt-out processing does not result in automatic account closure. Customers who wish to close their account entirely should submit a separate right-to-delete request.

Authorized Agents

Consumers may designate another person or entity to submit a CCPA request on their behalf. Authorized agents must provide:

  • Signed written permission from the consumer confirming authority
  • Identity verification information for the consumer

Brivonexi may contact the consumer directly to verify the authorization.
